We reserve the right to suspend any user violating these terms.

2. Intellectual Property

All content, reports, dashboards, text, graphics, trend models, analytics, insights, and proprietary processes offered through Datapiphany are the exclusive property of Datapiphany Inc., even when derived from public data sources.

You receive a non-transferable, non-exclusive license to access the Services.

You may not:

• claim ownership over Datapiphany data models or insights,
• replicate or redistribute dashboards,
• white-label Datapiphany without permission,
• or use Datapiphany as training material for competitive products.

All trademarks, branding, and service marks remain the sole property of Datapiphany Inc.

3. Subscription, Payment & Billing

3.1 Payment Processing

Payments are securely handled via Stripe. Datapiphany does not store full payment details.

3.2 No Refunds (Unless Required by Law)

Due to the digital and immediately-delivered nature of insights and trend reports, all sales are final.

3.3 Taxes

Users are responsible for taxes in their jurisdiction.

3.4 Pricing Changes

We may update pricing at any time. Existing subscriptions will receive advance notice.

4. Third-Party Data & APIs

Datapiphany analyzes aggregate data from:

• public platforms,
• licensed vendors,
• trend sources,
• and third-party APIs.

We:

• only ingest data allowed under each platform's terms,
• do not claim ownership over external data,
• and do not collect personally identifiable data from third-party APIs unless explicitly authorized by a user.

We are not responsible for:

• downtime or changes to third-party APIs,
• the accuracy of external platforms,
• or data limitations imposed by third-party providers.

5. No Professional Advice

Datapiphany provides insights, dashboards, and analytical information for informational purposes only.

It does not constitute:

• legal advice,
• financial advice,
• investment recommendations,
• or guaranteed predictions.

Users should validate insights before making strategic decisions.

6. Disclaimers & Limitation of Liability

Datapiphany is provided "AS IS" and "AS AVAILABLE."

We do not guarantee:

• continuous uptime,
• accuracy of insights,
• predictive outcomes of cultural trends,
• or compatibility with all devices.

6.2 Limitation of Liability

To the fullest extent permitted by law:

Datapiphany Inc., its employees, contractors, agents, and affiliates shall not be liable for:

• indirect, incidental, consequential, or punitive damages,
• lost profits, lost business, reputation damage,
• data loss, delays, or system errors.

Maximum liability is limited to the amount paid for the Services in the preceding 12 months.

7. Account Management & Termination

7.1 Your Responsibilities

You must maintain:

• accurate account details,
• secure login credentials,
• and responsible usage of the Services.

7.2 Termination by Us

We may suspend or terminate accounts for:

• misuse,
• non-payment,
• breach of these terms,
• or behavior that risks the integrity of the platform.

You may cancel your subscription at any time through your dashboard or by contacting support.

8. Data Security & Privacy

Your use of Datapiphany is also governed by our Privacy Policy, which explains how data is collected, stored, and used.

We use industry-standard security measures on all servers, cloud infrastructure, and data pipelines.

9. Modifications to the Terms

We may update these Terms periodically. Continued use of Datapiphany constitutes acceptance of the updated terms. Material changes will be communicated.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

Any disputes will be resolved through:

• informal negotiation, followed by
• binding arbitration in Delaware, unless prohibited by law.

No class actions are permitted.
